Bradwell Wind Farm - High Court blocks development
After a challenge in the High Court, plans by nPower Renewables to build a 10 turbine wind farm at Bradwell-on-Sea, on the Dengie Peninsula, have been blocked. This is the same developer proposing to construct a wind farm at Earl's Hall Farm, half a mile to the West of Clacton-on-Sea.
A consent order issued by the High Court says two "conditions" imposed by planning inspector Philip Major are unenforceable. This consent order means that the matter will be sent back to the Secretary of State for Communities and Local Government so that it can be "redetermined". This means that there could be a second Public Enquiry into the project.
The two "conditions" set by the Inspector in the Appeal Decison of 10th September 2007, and considered to be unenforceable, both RELATE TO ISSUES OF NOISE.
